Felony convictions in Oregon

Having a criminal history can cause barriers to employment, housing, and other essential resources. This page offers information about conviction relief and employment resources for those with felony convictions.

Conviction Relief

  • Expungement

A criminal record expungement (motion to set aside) is a means by which to clear or seal criminal (or eviction) history including convictions, dismissed charges, and arrests.

If a court grants the motion, all relevant state agencies will then be ordered to clear the approved conviction, charge, and/or arrest from the record. Once finalized, the offenses are considered to be non-existent, and the applicant will no longer have to legally disclose the criminal or eviction history.

In early 2022, SB 397 initiated changes in Oregon expungement law that allow many convictions that were previously ineligible for expungement, to now be eligible. To read the bill, click here.

For more information about the criminal expungement process or for referrals to legal services, explore our expungement page.

  • Senate Bill 819

SB 819 establishes a procedure for people convicted of felony offenses to petition their sentencing court for reconsideration of their conviction(s) and/or sentence(s). This bill went into effect in Oregon on January 1, 2022.

Each district attorney has the discretion to decide if and how they will utilize SB 819 in their county. Each district attorney who is offering sentence reconsideration under SB 819 will establish their own criteria and application process. The procedures/processes can vary tremendously across counties.

For information specific to the county in which you are seeking conviction relief, send us a message here.

For general information about SB 819 eligibility criteria, the petition process, or other information, click the link below to learn more with the Oregon Justice Resource Center.
